涉案文物艺术品有据鉴定规范刍议

    潘坤容(1990– ),女。复旦大学文物与博物馆学系硕士毕业。现任上海视觉艺术学院讲师。研究方向为文物保护技术,陶瓷修复材料。
    吴桥(1963 – ),男。毕业于北京大学中文系,获文学学士学位,华东政法大学法学专业研究生班。现为华东政法大学传播学院教授。研究方向为文化遗产学,法学。

On Evidence-Based Appraisal Standards of Cultural Relics and Artworks Involved in the Case

摘要:

2021年10月28日,国务院办公厅印发了《“十四五”文物保护和科技创新规划》,提出加强涉案文物鉴定评估机构建设,做好刑事、民事、行政等领域相关鉴定工作。支持文博单位、社会力量探索成立文物鉴定机构,提供公益性咨询和经营性活动相结合的鉴定服务。本文在对文物鉴定的概念与方法界定的基础上,参照我国民事诉讼中的证据规则,提出了涉案文物艺术品有据鉴定标准化程序构建,以及分类鉴定证据体系构建的理论设想,以期为制定出台文物司法鉴定通用程序规范与分类鉴定标准提供理论支撑。

Abstract:

On October 28, 2021, General Office of the State Council of the People’s Republic of China issued the “Fourteenth Five-Year Plan for Cultural Relics Protection and Technological Innovation”, proposing to strengthen the construction of the appraisal and evaluation institutions for the cultural relics involved in the case, in order to do a better appraisal job in the criminal, civil, and administrative fields. The establishment of appraisal and evaluation institutions by culture-related institutions or social forces should be supported and the institutions should provide appraisal services that combine non-profitable consulting and profitable activities. Based on the definition of the concepts and methods of cultural relics appraisal, this article puts forward the suggestion of the construction of a standardized procedure for evidence-based appraisal of cultural relics and artworks involved in the case, as well as theoretical notions for the construction of a classified evidence-based appraisal system, in order to provide theoretical support from formulating general procedures specifications and classified appraisal standards for judicial appraisal of cultural relics.
